1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Elzra Corp. ("Elzra", "we", "us", "our") regarding your use of the https://elzra.com website (the "Site") and the purchase of our products.
By accessing or using our Site, placing an order, or purchasing our products, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Site or purchase our products.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the modified Terms. We recommend reviewing this page periodically.
2. Eligibility and Account Requirements
You must be at least 13 years of age to place an order or make a purchase on our Site. By placing an order, you represent and warrant that you are at least 13 years old.
If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms and to be responsible for your purchases.
Our shop allows both registered user accounts and guest checkout. If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3. Products and Availability
Elzra Corp. designs, publishes, and sells tabletop games, board games, card games, and related gaming products. All product descriptions, images, prices, and availability information on the Site are subject to change without notice.
We make every effort to display product colors, features, and specifications as accurately as possible. However, we cannot guarantee that your device's display will accurately reflect the actual product colors or details.
We reserve the right to limit quantities, discontinue products, or refuse orders at our discretion. Product availability is not guaranteed until your order is confirmed and shipped.
Crowdfunding and Pre-Orders: Some products may be offered through crowdfunding campaigns (such as Kickstarter or Gamefound) or as pre-orders before mass production. These products are subject to additional terms:
- Pre-order items are sold on a first-come, first-served basis and are subject to manufacturing timelines.
- Pre-orders cannot be cancelled once mass production has commenced.
- Crowdfunding backers may receive different terms, pricing, or exclusive content compared to retail purchasers.
4. Pricing and Payment
All prices are displayed in the currency indicated on the Site and are subject to change without notice. The price charged for a product will be the price displayed at the time you submit your order, provided that order is accepted.
You agree to pay all charges incurred by you or on your behalf through the Site, at the prices in effect when such charges are incurred. You are responsible for any applicable taxes, duties, customs fees, or other charges imposed by governmental authorities.
Payment Processing: We accept payment via credit card, debit card, PayPal, and other payment methods as indicated during checkout. Payment processing is handled by secure third-party payment processors (including Stripe and PayPal) who are PCI-DSS compliant. We do not store your complete credit card information on our servers.
We reserve the right to refuse or cancel any order if we suspect fraudulent, unauthorized, or illegal activity, or if payment cannot be processed or verified.
5. Order Acceptance and Confirmation
Your receipt of an order confirmation email does not constitute our acceptance of your order. We reserve the right to accept or decline your order for any reason, including product availability, errors in product or pricing information, or issues identified by our fraud detection systems.
An order is considered accepted when we send you a shipping confirmation email indicating that your order has been dispatched.
6. Shipping and Delivery
Domestic Shipping: We ship within Canada and the United States. Estimated delivery timeframes are provided at checkout and are estimates only. We are not responsible for delays caused by shipping carriers, weather conditions, customs processing, or other factors beyond our control.
International Shipping: For international orders, you (the customer) are responsible for all customs duties, import taxes, brokerage fees, and any other charges imposed by your country's customs authorities. These charges are not included in our product prices or shipping costs.
Subsidized Shipping: For certain domestic orders within the United States, we may subsidize shipping costs. This is at our discretion and subject to change.
Risk of Loss: Risk of loss and title for products pass to you upon delivery to the shipping carrier. We are not responsible for lost, stolen, or damaged packages after they have been delivered by the carrier. If your package is marked as delivered but you have not received it, please contact the shipping carrier directly.
Shipping Address: You are responsible for providing an accurate and complete shipping address. We are not responsible for orders shipped to incorrect addresses provided by you. Address changes after shipment may not be possible.
7. Returns and Refunds
Return Window: You may return unopened products within 14 days of delivery for a refund. The product must be in its original, unopened condition with all packaging intact.
Return Process: To initiate a return, please open a support ticket at support.elzra.com with your order number and reason for return. We will provide return authorization and instructions.
Return Shipping: You are responsible for all return shipping costs unless the return is due to our error (e.g., wrong item shipped, defective product). We recommend using a trackable shipping method for returns.
Refund Method: Approved refunds will be processed to your original payment method within 7-14 business days after we receive and inspect the returned product. Shipping costs are non-refundable unless the return is due to our error.
Non-Returnable Items: The following items cannot be returned:
- Opened or used products
- Products not in their original packaging
- Products damaged due to misuse, neglect, or unauthorized modification
- Crowdfunding or pre-order items (unless defective)
- Clearance, sale, or discontinued items (unless defective)
Damaged or Defective Products: If you receive a damaged or defective product, please open a support ticket at support.elzra.com within 7 days of delivery and include photos of the damage. We will replace the item at no cost to you (including return shipping).
Damaged Boxes: Minor cosmetic damage to outer packaging or boxes (dents, scuffs, corner damage) does not qualify for return or replacement unless it affects the product inside. Major box damage that affects the product's integrity or resale value will be evaluated on a case-by-case basis.
8. Product Warranties and Disclaimers
Limited Warranty: Our supported products are warranted to be free from manufacturing defects in materials and workmanship under normal use for a period of 90 days from the date of delivery. All games currently listed on our Site are considered supported products. This warranty does not cover:
- Normal wear and tear (customer is responsible for wear and tear from regular use)
- Damage from misuse, abuse, negligence, or accidents
- Modifications or alterations made by anyone other than Elzra
- Products purchased from unauthorized resellers
- Cosmetic damage that does not affect functionality
Warranty Claims: To make a warranty claim for a supported product, please open a support ticket at support.elzra.com with proof of purchase, photos of the defect, and a description of the issue. If your claim is approved, we will replace the defective item or component at no charge.
DISCLAIMER OF WARRANTIES: EXCEPT AS EXPRESSLY PROVIDED IN THE LIMITED WARRANTY ABOVE, OUR PRODUCTS AND SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
We do not warrant that the Site will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant that product descriptions, images, or other content on the Site are accurate, complete, reliable, current, or error-free.
9. Limitation of Liability
LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ELZRA CORP., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of (or inability to access or use) the Site or products;
- Any conduct or content of any third party on the Site;
- Unauthorized access, use, or alteration of your transmissions or content;
- Delays or failures in delivery or performance;
- Any other matter relating to the Site or products.
MAXIMUM LIABILITY: IN NO EVENT SHALL ELZRA CORP.'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU TO ELZRA CORP. FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100 USD), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the above exclusions and limitations may not apply to you, and our liability will be limited to the maximum extent permitted by law.
10. Intellectual Property Rights
All content on the Site, including but not limited to text, graphics, logos, images, game designs, rules, artwork, product names, software, and compilation thereof (the "Content"), is the property of Elzra Corp. or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content without our prior written consent, except for:
- Personal, non-commercial use in accordance with these Terms;
- Content that is specifically made available for redistribution by us;
- Your own user-generated content that you submit to the Site.
Trademarks: Elzra, Elzra Corp., and our product names and logos are trademarks of Elzra Corp. You may not use our trademarks without our prior written permission.
User Content: If you submit reviews, comments, images, or other content to the Site, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
11. Prohibited Uses
You agree not to use the Site or our products for any unlawful purpose or in any way that violates these Terms. Prohibited activities include, but are not limited to:
- Violating any local, state, national, or international law or regulation;
- Infringing on any intellectual property rights of Elzra or third parties;
- Transmitting viruses, malware, or any other harmful code;
- Attempting to gain unauthorized access to the Site or our systems;
- Collecting or harvesting personal information from other users;
- Using the Site to transmit spam, advertising, or other unsolicited communications;
- Impersonating Elzra or any other person or entity;
- Interfering with or disrupting the Site or servers connected to the Site;
- Using automated systems (bots, scrapers) to access the Site without permission.
We reserve the right to terminate your access to the Site and take legal action if you engage in prohibited activities.
12. Third-Party Links and Services
The Site may contain links to third-party websites, services, or resources that are not owned or controlled by Elzra Corp. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
You acknowledge and agree that Elzra Corp. shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
13. Indemnification
You agree to defend, indemnify, and hold harmless Elzra Corp., its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms;
- Your use of the Site or products;
- Your violation of any rights of another party, including any intellectual property rights;
- Your violation of any applicable law or regulation.
14. Product Safety and Age Restrictions
Small Parts Warning: Our products may contain small parts that pose a choking hazard. They are not suitable for children under 3 years of age. Adult supervision is recommended for children under the recommended age for each specific product.
Dexterity Games Warning: Some of our games involve flicking, tossing, or propelling game components. These activities may result in components becoming projectiles. Please exercise caution when playing these games. We are not responsible for any eye injuries, property damage, or other harm that may result from gameplay. Keep components away from faces and fragile objects. Adult supervision is strongly recommended when children are playing dexterity games.
Natural Materials Disclaimer: Some of our products contain wood components. Natural wood may vary in color, grain pattern, and texture from piece to piece and from the images shown on our Site. These variations are inherent characteristics of natural materials and are not defects. We do not accept returns or provide replacements based solely on natural wood variations.
Age Recommendations: Age recommendations listed for our products are guidelines only. Parents and guardians are responsible for determining whether a product is appropriate for their child.
Proper Use: Our products are designed for recreational tabletop gaming use only. Do not use products in any manner other than their intended purpose.
15. Dispute Resolution and Governing Law
Governing Law: These Terms and any dispute arising out of or related to these Terms or the Site shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Jurisdiction: You agree that any legal action or proceeding arising out of or related to these Terms or the Site shall be brought exclusively in the courts located in Hamilton, Ontario, Canada. You consent to the personal jurisdiction of such courts and waive any objection to venue.
Informal Resolution: Before filing a formal legal claim, you agree to first contact us at legal@elzra.com to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith within 30 days.
16. Severability and Waiver
Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Elzra Corp.
17. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Site, constitute the entire agreement between you and Elzra Corp. regarding your use of the Site and supersede all prior agreements and understandings.
